These General Terms and Conditions of Use (the "Terms") govern access to and use of the website www.challenpay.com (the "Website") and the ChallenPay mobile application (the "App") by the User, as well as the contracting of services through them. The Website and the App are owned by ChallenPay LLC, a limited liability company organized under the laws of the State of Delaware, United States, with registered address at 16192 Coastal Highway, Lewes, Delaware 19958, USA (the "Company").
Anyone who wishes to access or use the Website, the App or the Company's Services must comply with these Terms, together with the other policies governing the Service, which are incorporated herein by reference, in particular the Privacy Policy. ANY PERSON WHO DOES NOT ACCEPT THESE TERMS, WHICH ARE BINDING AND MANDATORY, MUST REFRAIN FROM USING THE WEBSITE, THE APP AND ANY OTHER SERVICE OF THE COMPANY. The User acknowledges having read, understood and accepted these Terms and the documents incorporated by reference at the time of registration.
A.1. Participants. Users who enter Challenges and submit entries in order to compete.
A.2. Challenge Creators. Users who propose and organise Challenges within the Service. They define the rules, evaluation criteria, prize, duration, minimum number of participants and other parameters of the competition, and manage the entries received.
A.3. Jurors. Users approved by the Company to evaluate entries in Challenges with closed evaluation, according to the criteria published for each Challenge.
A.4. Voters. Users who take part in the public vote of Challenges that enable it.
A.5. General Users. Users who browse the Service and interact with the community without necessarily competing.
A.6. References to "Users" generally include all the types described in A.1 to A.5.
A.7. Challenges. The competitions organised within the Service, with rules, objectives and evaluation criteria set by the Creator or by the Company.
A.8. ChallenCoins. Non-monetary virtual assets used exclusively within the Service as a reward unit to encourage participation. ChallenCoins have no monetary value outside the Service, cannot be exchanged for real money, goods or services outside it, and cannot be transferred to bank accounts or other external payment methods.
A.9. Virtual wallet. The User's balance record within the Service, which may hold a money balance, ChallenCoins and experience points.
B.1. The Service is a digital platform that allows Users to discover available Challenges, create new ones with their own rules, take part by submitting entries, act as jurors, vote where public voting is enabled, and interact socially with other Users. Challenges are organised by category, theme, popularity and date, and the Service offers recommendations based on the User's activity.
B.2. The Service is not a game of chance or a betting platform. All competitions and votes are based on the skill, creativity and performance of the Participants and contain no element of chance or luck. The selection of winners depends exclusively on the criteria set for each Challenge and on the evaluation of the jury and the voters, as applicable. Results are never subject to draws or random mechanics.
C.1. By accepting these Terms, the User declares:
C.2. The Service is reserved for individuals aged 18 or over. Persons under 18 may not register or use the Service in any capacity. On registering, the User declares under their own responsibility that they are of legal age.
The Company may at any time require proof of the declared age by means of an identity document. If it detects or reasonably suspects that a User is under 18, it will suspend the Account, cease all processing of their data other than what is strictly necessary to document the closure, and return any available balance to the person who evidences legal representation.
C.3. Persons lacking legal capacity to contract, and persons suspended or barred by the Company, may not use the Service.
D.1. Merely browsing the Service confers the status of User and implies acceptance of these Terms, without prejudice to the express acceptance given at registration.
D.2. The Services may only be contracted by a User who has created an account (the "Account") by completing the mandatory fields of the registration form with authentic, current data and attaching any documentation requested. The User may use external credentials (Google, GitHub) to create and access the Account; in that case the User authorises the Company to access the information associated with those services in accordance with the Privacy Policy.
D.3. Date of birth. During registration the User must declare their date of birth. The Company automatically restricts access for anyone declaring to be under 18 and may require additional documentary verification where the declared date is close to the age of majority or where there are indications that the declaration is not truthful. Until that verification is completed, the User's access may remain limited.
D.4. Email and phone verification. The Company verifies the declared email address and telephone number by sending a link or a one-time code. Certain functions, including entering Challenges with money prizes and withdrawing funds, require both to be verified.
D.5. The User may not register using the name of another person, brand or company in a way that causes confusion, nor use an offensive, vulgar or obscene username. Breach of this clause may result in suspension or deletion of the Account.
D.6. The User undertakes to keep their data up to date and warrants its truthfulness, accuracy and currency. If the User provides false, incorrect, outdated or incomplete information, or if the Company has reasonable grounds to suspect so, the Company may suspend or terminate their access to the Service.
D.7. The User accesses the Account using their email address or telephone number and a personal security password, which must meet the minimum complexity requirements set by the Company.
D.8. The User undertakes to keep their password confidential and is responsible for all operations carried out through their Account. Selling, assigning or transferring the password to another User is prohibited.
D.9. The Company may, upon notice, temporarily or permanently close the Account of a User who breaches these Terms or the Privacy Policy, without this giving rise to any right to compensation.
D.10. Reporting impersonation. The Service provides a reporting function for impersonation and other improper conduct. Reports may also be sent to info@challenpay.com.
E.1. The Company reserves the right to amend these Terms. The version in force is always published on this page, with its version number and effective date.
E.2. Any amendment will be communicated to registered Users ten (10) calendar days before it takes effect, by email to the declared address. If the User disagrees, they may close their Account within that period by writing to info@challenpay.com or from their profile. If the period expires without objection, the User is deemed to accept the new version.
E.3. The Company may modify the design, configuration and functionality of the Service at any time. The User always retains the right to close their Account if they disagree.
F.1. The User undertakes to use the Service in accordance with the law, morality, public order and these Terms, and not to use it for unlawful activities, activities that infringe the rights of third parties, or that breach intellectual and industrial property regulations. The User further undertakes not to distribute or make available material contrary to the law, morality, public order or these Terms.
F.2. The User shall hold the Company harmless against any claim, fine, penalty or compensation arising from a breach of these rules.
F.3. The User is prohibited from breaching or attempting to breach the security of the Service, including without limitation:
F.4. In the event of conduct contrary to these Terms, the Company may suspend or cancel the User's Account.
G.1. The Service allows Users to create Challenges by defining rules, objectives, the dates of each stage, evaluation criteria, a minimum number of participants and a prize. The Creator may set the Challenge as public, open to the whole community, or private, restricted to a specific group.
G.2. Once published, the Challenge is distributed within the community so that Users can discover it and decide whether to take part.
G.3. The Creator may set an entry fee, denominated in money or in ChallenCoins, or publish the Challenge with no fee. Participants may also receive incentives for taking part, such as experience points.
G.4. Challenges with no entry fee. Where a Challenge without an entry fee offers a money prize, the prize must first be approved by the Company, which verifies that the committed funds are actually available before allowing publication. Until that approval is granted, the Challenge is not visible to other Users and accepts no entries. The Company may refuse approval and will notify the Creator of the refusal.
G.5. Sponsored Challenges. Where the prize is provided by a third-party sponsor, the sponsor must place the funds with the Company before publication. The sponsor does not thereby acquire the status of Creator or any authority over the evaluation or the selection of winners, unless expressly agreed and disclosed to Participants before they enter.
G.6. The Creator sets the duration of the Challenge and its stages: entry, submission of entries, evaluation and publication of results. The dates of each stage are shown on the Challenge page.
G.7. Minimum number of participants. The Creator sets a minimum number of Participants. If that minimum is not reached by the close of the entry period, the Challenge may be cancelled and entry fees are refunded in full to each Participant's virtual wallet, with no deduction or withholding.
G.8. Once entries are open, the Creator may not unilaterally change the rules, dates, fee or prize split. Changes must be requested from the Company, which approves or rejects them. Approved changes are notified to Participants already entered.
H.1. Users may enter the Challenges available provided they meet the requirements set by the Creator. Entry is completed on payment of the fee, where applicable, and gives access to the rules and guidance needed to take part.
H.2. Challenges involve a contest of merit and skill not subject to chance, on subjects such as sport and physical activity, video games, general knowledge, creativity and art, cooking and gastronomy, trades and services, social and communication skills, entrepreneurship and business, technology and programming, science, mental skill, hobbies, health and wellbeing, environment and sustainability, languages, practical skills, team competitions, timed challenges, fashion and style, social media, and innovation.
H.3. Entry fees paid by Participants are received and held by the Company in the Service's virtual wallet until the Challenge ends. Once the results are determined, the Company credits directly to the virtual wallet of each recipient the share due to them: the prize to the winners, the jury's share, the Creator's share and the Company's commission.
The Creator never receives or administers the entry fees of the other Participants and is not responsible for the material payment of the prize.
H.4. The balance credited to the virtual wallet is not a bank deposit and does not bear interest. The Company holds it solely so that it may be used within the Service or withdrawn in accordance with section K.
H.5. The total amount collected in entry fees is distributed among four destinations: the winners, the jury, the Creator and the Company. The percentages are set when the Challenge is created, are shown on its page before entry, and cannot be changed once entries are open. For paid Challenges denominated in money, the following limits apply:
| Destination | Limit |
|---|---|
| Jury | Between 1% and 20% where the Challenge is evaluated by a jury |
| Creator | Between 1% and 10% |
| Jury + Creator | Their combined total may not reach or exceed 80% |
| Winners | Must be greater than zero |
| Company | The remaining percentage, disclosed on the Challenge page |
H.6. Distribution among places. The Creator determines how the winners' pool is divided among the prize-winning places, up to a maximum of ten (10) places. The percentages assigned to the places must total exactly 100%, no place may receive less than 1%, and no place may receive a higher percentage than the place above it.
H.7. Prize currency. If the entry fee for a Challenge was set in ChallenCoins, the prize is awarded exclusively in ChallenCoins. Participants who paid their entry in ChallenCoins may not receive the prize in money, goods or services.
H.8. Crediting. Prizes are credited to the winners' virtual wallet once the final results of the Challenge have been published and it has been verified that no entries remain under review in a way that could alter the outcome.
H.9. A Participant who wishes to withdraw from a Challenge after entering must follow the procedure provided in the Service. The fee may be refunded according to the conditions set by the Creator; however, if the Participant has already submitted their entry or the Challenge is at an advanced stage, withdrawal and refund may not be allowed. This is without prejudice to the right of withdrawal set out in section U.
I.1. Before each Challenge begins, the applicable evaluation criteria are published and are visible to both Participants and the jury.
I.2. In closed evaluation, a panel of jurors evaluates the entries against the published criteria. Jurors are assigned by the Company from its register of approved jurors, taking into account their experience and their specialisation relative to the subject of the Challenge. A juror may accept or decline the invitation to join the panel.
I.3. For a juror's vote to be valid, the juror must evaluate every Participant assigned to them. The system verifies this condition before accepting the submission of votes.
I.4. The number of jurors assigned to each Challenge is determined by the Company according to the number of Participants and the complexity of the evaluation, and is shown on the Challenge page.
I.5. Once all votes have been cast, a results panel is generated and made visible to Participants, showing the scores obtained.
I.6. Audit. All jury activity — completed evaluations, scores awarded and comments — is recorded automatically. That record allows the process to be audited where questions arise about its fairness.
I.7. Jury share. Jurors receive the share of the prize provided for in H.5 once the evaluation is complete. Unjustified inactivity by a juror may lead to their replacement and to the loss of that share.
I.8. Where the Challenge enables it, the community takes part in the evaluation through a public vote. Before voting opens, the Creator configures which of the following formats applies:
I.9. The chosen format, the voting window, whether a cast vote may be changed, the visibility of interim results and the requirements a User must meet in order to vote are shown on the Challenge page before it begins.
I.10. Separate public-vote prize. Where so configured, the public vote may determine its own winner and its own prize, separate and independent from the outcome of the jury evaluation. This fact, the amount assigned and the number of winners by that route are shown on the Challenge page before entries open.
I.11. Integrity of the vote. The Company may set eligibility requirements for voting, limit the number of votes per User and per device, and invalidate votes where there are reasonable indications of manipulation, duplicate accounts or coordination intended to alter the result. Vote invalidations and their grounds are recorded and auditable.
I.12. In the event of a tie, the tie-break procedure provided in the Service applies, which may include an additional jury vote. Its outcome is communicated to the Participants concerned.
I.13. In order to preserve the integrity of the competition, the Company may:
Any intervention by the Company in an ongoing Challenge is recorded in the audit system and is disclosed to Participants where it affects the result.
I.14. A Participant may submit a reasoned claim regarding the result of a Challenge, the rejection of their entry or a sanction imposed, within thirty (30) calendar days of being notified, by writing to info@challenpay.com. The Company will acknowledge receipt, review the relevant audit records and issue a reasoned response within ten (10) business days. A claim does not in itself suspend the distribution of prizes, unless the Company decides otherwise because the claim is manifestly plausible. This route neither replaces nor limits any rights granted to the User by consumer protection law.
J.1. The experience points system gamifies the User experience, awarding points for completing certain activities within the Service, such as registering, completing the profile, entering a Challenge, creating a Challenge, casting a vote, evaluating as a juror and placing in the prizes.
J.2. Each User has a panel showing their accumulated points and progress.
J.3. Levels. The level system reflects the User's accumulated activity and comprises one hundred (100) levels, grouped into eleven tiers: Novato, Aprendiz, Talento, Estrella, Virtuoso, Maestro, Sabio, Héroe, Leyenda, Mítico and Inmortal. The experience points required for each level and the benefits associated with it are shown within the Service and may be modified by the Company without affecting levels already reached.
J.4. ChallenCoins. Users may obtain ChallenCoins by taking part in Challenges, achieving good results and reaching levels. ChallenCoins may be used to enter Challenges whose fee is denominated in that currency and for such other purposes as the Company enables within the Service.
J.5. ChallenCoins are not money, have no value outside the Service and may not be exchanged for cash under any circumstances. The Company may change how they are obtained and used, and may set validity periods, giving reasonable prior notice.
J.6. The Company may in future introduce the purchase of ChallenCoin packs with real money, the exchange of points for ChallenCoins, and reward catalogues. The description of these features is informative only and creates no right to demand their implementation.
K.1. The virtual wallet allows the User to manage their money balance, ChallenCoins and points within the Service. The money balance may come from top-ups made by the User, prizes won, shares received as juror or Creator, and refunds.
K.2. Top-ups. Top-ups are processed through an external payment platform. The Company neither receives nor stores credit or debit card data. The balance is credited once the payment platform confirms the transaction.
K.3. Before withdrawals are enabled, the User must complete an identity verification process comprising the upload of images of their national identity document or other equivalent official document, validation of their tax identification number, and confirmation that their country of residence is among those enabled by the Company. This process is carried out with the involvement of a specialist provider, as described in the Privacy Policy.
K.4. The Company may reject the verification or require it to be repeated where the documentation is illegible, inconsistent or apparently altered, and will inform the User of the reason for the rejection.
K.5. The User may request withdrawal of the money balance available in their virtual wallet to a bank account held in their own name. The minimum withdrawal amount is five hundred Argentine pesos (ARS 500).
K.6. Every withdrawal request is subject to review by the Company, which verifies that the User's verified identity matches the ownership of the destination account. The Company may reject requests where there is a mismatch of account ownership, where the Account is suspended or under investigation, or where transactions remain pending settlement, stating the reason.
K.7. ChallenCoins and experience points are neither withdrawable nor convertible into money.
L.1. Prizes are paid in accordance with applicable tax law. Where legislation requires the Company to act as a withholding, collection or reporting agent, the Company will apply the corresponding withholdings to the prize amount and provide the User with the relevant certificate.
L.2. Taxes levied on the prize in the hands of the User, as well as the declaration of amounts received to the tax authorities of their jurisdiction, are the User's sole responsibility.
M.1. Use of the Service is in all cases at the User's sole responsibility and risk. The Company does not guarantee the availability and continuity of the Service, the inviolability of data transmitted over public networks, or the absence of malfunctions or viruses. The User releases the Company from all liability arising from acts of God or force majeure.
M.2. THE USER ACKNOWLEDGES AND ACCEPTS THAT THE COMPANY SHALL NOT BE LIABLE FOR THE SUSPENSION OR INTERRUPTION OF THE SERVICE OR FOR FAILURES IN ITS PROVISION DUE TO ACTS OF GOD, FORCE MAJEURE OR THE ACT OF A THIRD PARTY, NOR FOR ANY DAMAGES ARISING THEREFROM.
M.3. The Service is provided "as is", without any warranty of uninterrupted or error-free operation.
M.4. The User is solely responsible for the control of their password, their email address and the use of their Account.
M.5. The Company cannot ensure the absence of third-party intrusions. The User releases the Company from liability where third parties breach its security systems or gain access to the User's password and take actions that harm them.
M.6. These clauses do not limit the non-waivable warranties or consumer protection rights available to the User under the mandatory laws of their country of residence.
M.7. EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, THE COMPANY'S AGGREGATE LIABILITY TO THE USER OR TO ANY THIRD PARTY, IN ANY MATTER ARISING FROM THE SERVICE OR THESE TERMS, SHALL NOT EXCEED THE AMOUNTS PAID BY THE USER TO THE COMPANY DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
M.8. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY OR CONSEQUENTIAL DAMAGES ARISING FROM THE CONDUCT OF THE USER OR OF ANY OTHER PERSON IN CONNECTION WITH THE SERVICE, INCLUDING DAMAGE TO PROPERTY, THEFT, PERSONAL INJURY, DEATH AND EMOTIONAL DISTRESS, NOR FOR INTERACTIONS BETWEEN USERS, WHETHER ONLINE OR IN PERSON.
M.9. In the event of a dispute between Users, the User agrees to release the Company from any claim and damage arising from that dispute.
M.10. Cancellation of the Account may result in the loss of content and functionality. The User is responsible for backing up their own materials.
N.1. The User shall hold the Company harmless, together with its directors, representatives and employees, against any administrative or judicial claim brought by another User, by third parties or by any authority, in connection with the use or contracting of the Service.
N.2. This obligation extends to any claim, damage or loss arising from relationships between Users.
N.3. The Company is not responsible for claims, injuries, losses or damages arising from the User's interactions with other Users, whether physical or virtual.
To use the Service, the User must provide certain personal data, which is processed and stored in accordance with the Privacy Policy, which forms an integral part of these Terms. Text and WhatsApp messages sent by the Company are further governed by the Messaging Terms and the Messaging Privacy Policy.
P.1. Subject to these Terms, the Company grants the User a non-exclusive, non-transferable, non-commercial and limited right to use the Service, excluding any other right not expressly granted. The User may not rent, copy, assign, sublicense, sell, lease, reproduce, donate, lend or distribute the Service in any manner.
P.2. All usage rights are granted under licence; no ownership right in the Service is transferred to the User.
P.3. The User undertakes not to use the Company's trademarks, patents, designs, logos, trade names, copyrights, domain names or other intellectual and industrial property rights without prior written authorisation.
R.1. The User warrants that they own all rights in the content they upload to the Service (the "User Content"), including images, videos, audio, text and any other material, or that they hold the licences and authorisations necessary to use and publish it.
R.2. Licence granted to the Company. The User grants the Company a free, worldwide, non-exclusive licence to reproduce, transform, distribute and communicate the User Content to the public within the Service and in communications and promotional materials for the Service, for the legal term of the rights. This licence includes the addition of watermarks and other protection mechanisms.
R.3. The User warrants that the Company's use of the User Content does not infringe any intellectual property, image or other rights belonging to third parties, and undertakes to hold the Company harmless in the event of infringement.
R.4. On deleting their content or closing their Account, the licence for new uses ceases, without prejudice to copies the Company must retain by legal obligation or to evidence the conduct of a Challenge already concluded, and to promotional materials already published.
R.5. In no case may the Company be regarded as the "Publisher" of the User Content; it does not endorse that content and assumes no liability for it or for its loss, deletion or damage.
R.6. Intellectual property complaints. Any rights holder who believes that content published on the Service infringes their rights may notify info@challenpay.com, identifying the content, the right invoked and their contact details. The Company will review the notice and may remove the reported content, notifying the User who published it, who may then submit a response.
S.1. The Community section encourages interaction between Users. Users may publish content visible on their profile and in their followers' feed, follow other Users, comment, react and share content.
S.2. Users receive notifications about the activity of the people they follow and about relevant events in their own account.
S.3. Users may manage their lists of followers and of accounts they follow.
S.4. Messaging. The Service includes a messaging tool that allows Users to communicate privately with one another. Users may accept or decline message requests, and mute and archive conversations.
S.5. The Company may restrict a User's ability to start conversations where well-founded reports have been made against them.
S.6. Future features. The Company may in future introduce new features, such as live streaming and group conversations. Their description is informative only and creates no right to demand their implementation, nor any obligation to develop or maintain them.
T.1. Without prejudice to other measures, the Company may warn, temporarily suspend or permanently disable a User's Account, and take such legal action as it deems appropriate, where it considers that:
T.2. In relation to published content, the following conduct, among others, will give rise to sanctions:
T.3. In response to such breaches, the Company may apply the following sanctions: temporary suspension of the Account; removal of the infringing content without prior notice; permanent disabling of the Account where the conduct is serious or repeated; removal or invalidation of entries in Challenges, with forfeiture of prizes obtained irregularly or fraudulently; and restriction of access to certain functions.
T.4. If a Challenge created by a User proves unlawful, inappropriate or contrary to these Terms, the Company may suspend or remove it without prior notice, apply additional sanctions to the Creator and, in the most serious cases, take legal action.
T.5. All audiovisual content uploaded by the User to the Service is subjected, before publication, to automated analysis designed to detect child sexual abuse material, using hash-matching technology provided by a third party. Until that analysis is successfully completed, the content remains unpublished. The User acknowledges and accepts this analysis as a condition of the Service.
T.6. Where the analysis, or subsequent human review, produces a confirmed match, the Company will immediately suspend the Account, preserve the content and associated metadata for evidentiary purposes, and make the corresponding report to the competent authorities and bodies, including the National Center for Missing & Exploited Children (NCMEC) of the United States of America and the Argentine authorities. This report is made in compliance with legal obligations and requires neither the consent nor the prior notification of the reported User.
T.7. Any User may report content or conduct they consider contrary to these Terms, using the reporting function in the Service or by writing to info@challenpay.com. The Company reviews the reports received and takes such measures as appropriate.
T.8. A sanctioned User may submit a response within thirty (30) calendar days of being notified of the sanction, by writing to info@challenpay.com, following the procedure in I.14. The Company will review the response and may uphold, reduce or set aside the measure. This procedure does not apply to suspensions based on T.6, which are governed by applicable law.
U.1. Withdrawal. A User who qualifies as a consumer under applicable law may withdraw from the contracting of paid services concluded through the Service within ten (10) calendar days of contracting, without giving reasons and at no cost. Withdrawal is exercised through the withdrawal link available on the home page of the Website and in the App, or by writing to info@challenpay.com. The Company will refund the amounts paid using the same payment method, within the statutory time limits.
U.2. Limitation. The right of withdrawal does not apply to entry into a Challenge where the Participant has already submitted their entry or where the entry stage has closed, as this constitutes a service whose performance began with the User's agreement. This limitation is disclosed to the Participant before entry is confirmed.
U.3. Closing the account. The User may request closure of their Account at any time, without giving reasons, using the cancellation link available on the home page and in their profile settings. The Company will issue a receipt for the request within twenty-four (24) hours.
U.4. Closing the Account does not extinguish the User's outstanding obligations or amounts owed, and does not prevent the Company from retaining information it is legally required to keep, in accordance with the Privacy Policy. Any money balance available at the time of closure may be withdrawn in accordance with section K.
V.1. If any of these clauses is declared void, that will not affect the validity of the remainder, which shall remain in full force.
V.2. These Terms, together with the documents incorporated by reference, constitute the entire agreement between the User and the Company.
V.3. The Company's forbearance in the face of a breach shall not be construed as a waiver of its right to require compliance.
V.4. These Terms do not create any partnership, joint venture, employment relationship, agency or franchise between the User and the Company.
V.5. Frequently asked questions. Answers to frequently asked questions published in the Service are for general information only and do not constitute advice of any kind. These Terms always prevail over that content.
W.1. These Terms are governed by the laws of the State of Delaware, United States. Any dispute arising from this agreement — its existence, validity, interpretation, scope or performance — shall be submitted to the ordinary courts of Miami, Florida.
W.2. Consumer carve-out. W.1 does not deprive a User who qualifies as a consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence, nor of their right to bring proceedings before the courts of their own domicile. For Users resident in the Argentine Republic, that country's consumer protection and personal data protection rules apply, and such Users may sue and be sued before the courts of their domicile.
W.3. Before resorting to the courts, the parties shall seek to resolve the dispute through the claims procedure set out in I.14.
